Terms & Conditions
Effective 29 July 2026This is the application operating policy. The software provider should have it reviewed against its final business identity, sales process and deployment arrangements before commercial launch.
1. Agreement and scope
These terms govern access to and use of Fencalc XA2021, including its project workspace, calculation tools, collaboration features, training material and report outputs. By creating an account or using the service, you agree to these terms and the Privacy Policy.
2. Purpose of the service
Fencalc supports the collection, calculation and documentation of building energy information. It is a professional workflow tool, not a substitute for the official standard, project documents, product certification, professional judgement or approvals required for a specific project.
3. Accounts and security
You must provide accurate account information, keep credentials confidential and notify the service operator if unauthorised access is suspected. Actions taken through an account are treated as actions of that account holder unless the operator is notified otherwise.
4. Projects and collaboration
Projects are associated with an owner account. Owners may grant viewer or editor access to other registered users. The owner is responsible for choosing collaborators and reviewing access when team membership or project responsibilities change.
5. Subscriptions and manual payments
Available plans, trial periods, seats, expiry dates and commercial terms are those shown in the application or agreed in writing. Manual payments are not treated as approved merely because a transaction reference was submitted. Subscription access changes only after an administrator verifies and approves the reference.
6. User responsibilities
You are responsible for the accuracy, completeness, source and interpretation of project inputs. You must check calculations and reports against current project information and the official requirements applicable to the work before relying on or issuing an output.
7. Acceptable use
You may not attempt to bypass access controls, interfere with the service, introduce malicious code, use another person's account without permission, extract data belonging to another user, or use the service for unlawful activity.
8. Content and ownership
You retain responsibility for project information and branding uploaded to your account. The application, its interface, code, training structure and original documentation remain the property of their respective owner or licensors. You grant the service only the access needed to operate, secure and support your account.
9. Reports and decisions
Generated reports reflect the data and application version used at the time of generation. A displayed result does not guarantee regulatory approval, product suitability or construction performance. Reports should be reviewed and issued by the person responsible for the assessment.
10. Availability and changes
The operator may maintain, improve or change the service and its reference data. Reasonable efforts should be made to protect availability and existing data, but uninterrupted operation cannot be guaranteed. Material changes to these terms should be communicated through the service or the subscription contact channel.
11. Suspension and termination
Access may be restricted for an expired subscription, a security risk, prohibited use or a material breach of these terms. Account and project export arrangements, where offered, remain subject to the applicable plan and written agreement.
12. Liability
To the extent permitted by applicable law, the service is provided as a calculation and documentation aid. The operator is not responsible for loss caused by inaccurate source data, unreviewed outputs, unauthorised account use, or decisions made without the required professional and regulatory review.
